Basically, concurrent filing – meaning the simultaneous submission of Form I-130 (Petition for Alien Relative) and Form I-485 (Adjustment of Status) – is allowed when an immigrant visa is immediately available to the beneficiary. In cases of immediate relatives of U.S. citizens (such as spouses, children under 21 years old, and parents), this availability is guaranteed, allowing joint submission of the forms.

However, for family preference categories (F1, F2B, F3, and F4), adjustment of status (I-485) may only be initiated when the priority date is current according to the Visa Bulletin published monthly by the U.S. Department of State. Therefore, in category F cases, after filing the I-130, the beneficiary will need to wait until their priority date is current before they can file the I-485.

This means that in practice, concurrent filing is not common for category F, unless, exceptionally, the priority date is current at the time of submission – a situation which historically occurs rarely due to high demand and the limitations on visa numbers available in this category.
