The EB-1C is the route for multinational executives and managers transferred from an overseas company to a branch, subsidiary, or affiliate in the United States. What matters in the analysis is not the size of the team, but the nature of the role: the position must genuinely be executive or senior-level managerial.

Having 50 direct reports helps build the case, but it is not decisive on its own. An “Operations Manager” tends to qualify when the role involves strategic decision-making, oversight of broad areas of the operation, or the supervision of other managers who in turn lead their own teams. If the function is more technical or operational, without real decision-making authority, the fit becomes weaker, even with a large team.

  • Demonstrate decision-making power and responsibility over strategy, budget, or entire business areas.
  • Document the chain of command with organizational charts, job descriptions, and company letters.
  • Establish the corporate link between the overseas company and the U.S. entity (branch, subsidiary, or affiliate).

The applicant must also have served in a managerial or executive capacity at the overseas company for the qualifying period required.
