It depends on how your role is characterized. The EB-1C is designed for executives and managers of multinational companies who will lead an entity in the United States, and what is known as managerial capacity is typically associated with team supervision and strategic decision-making.

That said, managing only processes does not automatically rule out eligibility. Managerial capacity can also encompass overseeing an essential function of the organization at a senior level, not just direct supervision of people. What the authority evaluates is the actual nature and scope of your responsibilities.

  • If you lead a critical area or function with autonomy and meaningful decision-making, that tends to support your case.
  • If the role is purely operational, with no leadership or strategic responsibility, it becomes harder to qualify.
  • Documenting your organizational chart and your actual role thoroughly is decisive.
