This category does not require you to be promoted now or to take on a new position: it looks at the executive or managerial role you already performed abroad, during a recent qualifying period, at a company with a qualifying relationship to the organization in the United States.
In other words, what supports the petition is evidence of the leadership functions you have already carried out, not a future career move. If you served as an executive or manager and can document that, an internal disagreement does not erase that history.
The risk arises through a different channel: when the conflict compromises your documentation. Pay close attention to points such as:
- Letters and organizational charts confirming your leadership responsibilities.
- Evidence that the qualifying relationship between the companies remains in place.
- Records that describe your functions without relying solely on current management goodwill.
