What is an RFE?

An RFE (Request for Evidence) is an official USCIS notification requesting additional documents or clarifications to evaluate a petition, such as an L visa petition. Despite the alarm it often causes, an RFE is not a denial.

In practice, an RFE is issued when the initial review identifies a missing document or a point that needs to be better substantiated. It can arise in visa petitions as well as in adjustment-of-status cases, and it works as an opportunity to strengthen the case before a final decision is made.

When you receive an RFE, a few practices make a real difference:

  • Read carefully exactly what is being requested, item by item.
  • Gather organized documentation that addresses each point raised.
  • Respect the deadline indicated in the notification itself and respond completely, ideally all at once.
