It depends, and the answer lies in your current status, not in the lottery itself. Not being selected in the H-1B lottery means only that, in this cycle, you cannot begin work under that visa. It does not automatically require you to leave the United States.

What determines your ability to remain is the status you already hold and how you maintain it:

  • If you are in the country under another valid status, such as a student visa F-1 or another nonimmigrant category, you may continue in that status as long as you comply with its conditions, and try the lottery again in the next cycle or pursue another visa pathway.
  • If you do not have a valid authorization to remain when you are left out of the lottery, you need to take steps to regularize your situation in accordance with the law.

The critical point is not to exceed your authorized period of stay, because accumulating unlawful presence can harm future petitions and entries. Missing the lottery is not, in itself, an authorization to remain.

Since every case is different, the ideal approach is to confirm your options and timelines with USCIS or an immigration professional, and to avoid sources that promise guaranteed solutions.
