It depends on the position. In most cases, changing status to H-1B cannot happen at any time: the visa is typically subject to an annual cap (known as cap-subject) and therefore follows a cycle with defined steps and windows throughout the year, rather than a continuous open process.

Within that typical cycle, even if you already have a job offer, the petition must be filed within the designated registration window. When demand exceeds the number of available slots, a lottery selection takes place, and only after selection and approval does the new status take effect, starting at the beginning of the corresponding fiscal period.

There is, however, an important group of exceptions. Positions at certain institutions may be considered exempt from the cap (cap-exempt), which allows for a change of status at other times, outside the cap calendar. This includes, for example:

  • Higher education institutions.
  • Nonprofit organizations affiliated with those institutions.
  • Related entities, subject to applicable criteria.

Because the exact deadlines and windows shift from one period to the next, the safest approach is to confirm the current calendar with USCIS and assess, with a specialist, whether your situation is cap-subject or cap-exempt before planning your status change.
