F1 can skip quota if spouse of a military member?

Being the spouse of a U.S. military member can avoid the quota, but only if the petition is filed as an immediate relative; otherwise, the F1 category maintains the usual limitations.

It is important to understand that the benefits related to ”skipping the quota” are normally applicable when the beneficiary falls under an immediate relative category – such as the spouse of a U.S. citizen – and not a numerically limited preference category, like the traditional F1.

Therefore, simply being a military spouse does not, by itself, guarantee exemption from the quota if the immigration process was initiated under the F1 classification. According to U.S. law, beneficiaries classified as ”immediate” (spouses, minor children, and parents of U.S. citizens) are not subject to annual numerical limits.

If the military member is a U.S. citizen and their spouse is entering as an immediate relative, the category used would be immediate immigrant, and in that case, there would be no waiting for visa availability. However, if the immigration benefit was requested under the F1 category – traditionally meant for unmarried adult children (over 21) of U.S. citizens – even the status of being associated with a military member does not automatically transfer that qualification to immediate immigrants.

In this scenario, the quota still applies according to the rules of the F1 category. It is essential to meticulously verify your classification and whether the petition was actually filed under the category that benefits from quota exemptions. If the military member is a U.S. citizen and their spouse can be considered an immediate relative, it is recommended to reassess the petition so that it fits this category, provided all legal criteria are met.

Furthermore, each case has particularities and changes may occur in the legislation or in the interpretation of immigration rules. I emphasize the importance of following U.S. immigration laws and exercising caution when obtaining information. It is always advisable to seek guidance from professionals specialized in this subject to avoid scams or unfounded promises of guaranteed results. Staying well informed and consulting reliable sources is essential to make decisions appropriate to your specific case.
