There is no per-project visa cap in EB-5. A single development can receive investment from multiple participants, as long as each one meets the program requirements, such as job creation. The cap is not set at the project level.

What does exist is an annual issuance limit for green cards across the entire EB-5 category, established by law and applied at the program level, not the project level. There are also per-country-of-birth limits that can affect the pace of issuance for applicants from certain origins.

In practice, this means that:

  • Multiple investors can participate in the same project at the same time.
  • When demand exceeds annual availability, waiting lines form.
