Do I need to have generated the wealth myself, or can I use funds received from relatives in the EB-5?

In the EB-5 you can invest funds received from relatives: what matters is proving the lawful origin, both of the transfer and of how your family member obtained the assets. Build a traceable chain of evidence.

You do not need to have generated all the wealth personally. In the EB-5 process, what is required is that the invested funds have a lawful origin and are well documented, so resources received from relatives (or from other sources) are acceptable, as long as the legal origin is clearly demonstrated.

The key concern is the chain of evidence. When the money comes from family members, you must document both the transfer to you and the lawful origin of the funds in the hands of the person who transferred them. Gifts, inheritances, and other legal mechanisms are viable, provided each step is traceable.

  • Transfer documents: gift agreements, deeds, bank statements.
  • Proof of origin at the source: how your relative legally obtained that wealth.
  • Tax and financial records that tie together the full money trail.

Because the process involves rigorous scrutiny and any gap can complicate the case, it is worth organizing this documentation carefully and verifying the updated requirements with the USCIS, ideally with the support of a specialist.
