Are there age requirements for the EB-5?

There is no age limit, minimum or maximum, for the EB-5. Age does not determine eligibility: what matters is having the required capital, demonstrating a lawful source of funds, and meeting the program criteria.

There is no age limit, minimum or maximum, to participate in the EB-5 program. Age alone is not a factor used to determine eligibility. What truly matters is the investor’s ability to contribute the required capital and meet the other program criteria, regardless of how old they are.

The EB-5 is a green card pathway through investment in a job-creating enterprise in the United States. The evaluation focuses on the soundness of the investment and its economic impact, not on the investor’s age group. In practice, this means attention falls on other key points:

  • The ability to make the capital investment required by the program.
  • Demonstrating the lawful source of the funds.
  • Directing the capital to a qualifying project or regional center.

A separate note applies to very young investors, where the source of funds may require more detailed explanation, but that is a documentation matter, not an age restriction.

Since each case is evaluated individually, the best approach is to verify the current requirements from the official source and work with a specialist to structure the petition.
