The EB-4 immigrant visa is granted by a United States government authority after the approval of the I-360 petition, processed by the United States Citizenship and Immigration Services (USCIS).

The final issuance of the visa, when the applicant is outside the country, is carried out by the U.S. Department of State through U.S. consulates or embassies. After approval of the I-360, if outside the U.S., the case is forwarded to the National Visa Center (NVC) and then to the local consulate where the interview takes place and, if approved, the visa is issued.

Those who are inside the U.S. may opt for an internal adjustment of status through USCIS, without the need for the consulate.
