Who qualifies for Table B (Date for Filing) in the EB-2 NIW Visa Bulletin?

Table B (Date for Filing) in the Visa Bulletin lets you begin the EB-2 NIW process before the visa is issued, as long as your priority date is compatible. Check the current edition before filing.

The Visa Bulletin, published monthly by the Department of State, includes two tables: Table A (Final Action Date), which marks when a visa can actually be issued, and Table B (Date for Filing), which indicates when it is already possible to file the application, even without the visa immediately available for issuance.

You qualify for Table B if you have a petition in an employment-based preference category, such as the EB-2 NIW, and your priority date (the date your petition was filed) is on or before the date listed in Table B for that month. When your priority date is ‘current,’ the filing window opens.

  • If you are in the United States: you may file for adjustment of status.
  • If you are abroad: you may begin consular processing.

In practice, Table B allows you to start the process earlier: you can organize and submit your documentation while waiting for the final availability indicated in Table A. This does not guarantee immediate visa issuance, but lets you move forward in a more organized way.

Since the Visa Bulletin changes every month and Table B is not always open for use, check the current edition on the Department of State website and the USCIS instructions before filing.
