What do I need to demonstrate to prove ‘exceptional ability’?

In the EB-2 NIW, exceptional ability is not a box you check by completing a closed list. The idea is to demonstrate, on an overall basis, that your level of expertise is well above what is normally found in your field.

Rather than aiming for an exact count, focus on gathering varied types of evidence that, taken together, tell that story. Common elements include:

• Advanced academic training in your field.
• Recognized professional experience with broad impact.
• Relevant awards, distinctions, and recognitions.
• Publications and citations of your work.
• Membership in prestigious professional associations.

The weight lies not in the number of items, but in the consistency of the overall picture and the impact it demonstrates. USCIS reviews the case as a whole, according to its own standards, and it is USCIS that sets the applicable benchmark.

Because these criteria are assessed individually and may be updated, do not work from a fixed number in your head. Check the official USCIS requirements and, if possible, validate your eligibility with a specialist before filing.
