I have a technical degree and 10 years of experience: can I apply for EB-2 NIW?

A technical degree and experience may face challenges under EB-2 NIW, which requires an advanced qualification. The NIW waives the job offer, not that baseline: assess your profile on a case-by-case basis.

It depends on your overall profile, and there may be challenges. The EB-2 NIW starts from an advanced qualification: an advanced academic degree (or recognized equivalent) or demonstrated exceptional ability in your field. A technical degree combined with experience does not automatically meet that baseline.

An important point: the National Interest Waiver waives the job offer and labor certification requirements, but it does not replace the underlying qualification required by the EB-2 category. Practical experience counts, but it is assessed together with your educational background and your achievements.

This does not close the door entirely. When there is strong evidence of nationally significant contributions and recognition in the field, it is possible to build a case, even if more complex. Each situation is analyzed individually.

Since the eligibility framing depends on the specifics of your background, it is worth evaluating your profile with a qualified specialist and confirming the current requirements with the USCIS before deciding on a path.
