In the traditional EB-2, the usual path runs through an employer who offers the position and carries out the labor certification, a stage that checks the effect of the hire on the American labor market. As a rule, the process depends on that sponsorship.
In the EB-2 NIW (National Interest Waiver), a waiver of that offer and of the certification is requested. In exchange, the candidate takes on the burden of showing that their work has merit and national relevance enough to justify the waiver. This opens the door to self-petition, without depending on an employer.
