You may qualify, but the number of people you supervise is not, on its own, what decides the case. The EB-1C evaluates the nature of the role: whether it is genuinely executive or managerial, not how many direct reports you have.
A VP of marketing title can fit, provided the position involves more than operational oversight. What matters is demonstrating that you make strategic decisions and lead a meaningful area or function with influence over business direction. Points the analysis typically considers:
- Whether the role is recognized as executive or senior managerial within the organizational structure.
- Whether it involves strategic decisions rather than day-to-day execution.
- How the hierarchy and responsibilities are described within the company.
You must also have served in that executive or managerial capacity outside the United States for a qualifying period within a recent window, and continue in an equivalent role at a related U.S. entity. The organizational structure and job description are decisive factors.
