When analyzing the E-2 and EB-5 categories, it is possible to see that they have quite distinct structures and requirements. In general terms, the E-2 visa is usually considered less burdensome in terms of initial investment and procedures, but this does not necessarily mean it is ‘simpler’ in all aspects, as each program has its peculiarities and objectives.

In the case of the E-2, the investor must be a citizen of a country that maintains a trade treaty with the United States and demonstrate that they will make a substantial investment in an American company. Generally, the amount required for the investment is significantly lower than the amounts stipulated for the EB-5.

Moreover, the E-2 does not automatically lead to obtaining permanent resident status, as its nature is temporary, and it can be renewed indefinitely while the business continues to operate and comply with the program’s requirements.

On the other hand, the EB-5 program requires investments of larger amounts – which can vary depending on the location and nature of the enterprise – and requires the creation of a specific number of jobs for American people. Although it is considered more complex in financial terms and in proving job creation, the EB-5 offers the investor and their family the possibility of obtaining the green card, which is an advantage for those seeking permanent residence in the United States.

Regardless of the chosen category, it is essential to strictly follow the United States immigration laws and stay informed through reliable sources. Hiring specialized companies and being cautious about miraculous promises of quick solutions are also important measures to avoid scams or future problems.

Each situation has specific nuances; therefore, knowing in detail the requirements of each visa and evaluating which fits best your profile and objectives is an essential step.

In summary, although the E-2 may seem less complex due to lower capital requirements and a more temporary investment approach, the choice between the two visas will depend on what the investor is seeking – either the possibility of a quicker entry into the United States or the expectation of permanent residence through the EB-5.
