The L-1 is a specific pathway for transfers within the same corporate group, so not every professional fits the profile. Generally, those who lack the core elements of the category tend to fall outside its scope.

Those who typically do not qualify include:

  • those who do not meet the qualifying period of continuous employment with the overseas company prior to the transfer;
  • those who perform functions without a managerial, executive or specialized knowledge character (outside the L-1A or L-1B profile);
  • self-employed individuals and independent consultants without a genuine employment relationship with the group;
  • cases where there is no formal corporate link (ownership control or corporate relationship) between the foreign company and the U.S. entity.
