The IR1 visa is granted to spouses of U.S. citizens and confers permanent resident status (Green Card). However, this status comes with the understanding that the holder”s primary domicile is the United States. When the resident stays outside the country for prolonged periods, it may raise questions about the maintenance of that domicile. Staying outside the US for more than 12 months without a reentry permit, that is, an authorization to reenter, may be interpreted by immigration authorities as a possible abandonment of permanent resident status. This is because, in practice, the law presumes that the Green Card holder maintains ties and a clear intention to make the United States their permanent residence.

If you stay away for a long time, upon returning, you may be subjected to more rigorous questioning at the port of entry, with the possibility of having your status questioned and, in extreme cases, even being denied entry, considering that there was an interpretation of intent to abandon residency. Furthermore, prolonged absence can affect aspects related to obtaining future benefits or even when renewing the Green Card, causing complications that could be avoided with proper planning of your trips and stays outside the country.

It is recommended, when necessary, to apply for a reentry permit before leaving, as this document may allow longer absences without losing permanent resident status. Always remember that strictly following immigration laws is essential. If you have doubts or are planning a prolonged absence, consulting specialists is a prudent measure to ensure that all procedures are correctly followed. Be wary of offers that guarantee miraculous results or promise easy solutions, as the correct path always depends on strict compliance with current legislation.
