Should my American spouse travel with me?

It is very common to have doubts about whether the American spouse needs to travel together during the IR1 visa process.

This type of visa is intended for foreigners married to U.S. citizens, and the procedure primarily focuses on evaluating the applicant”s immigration benefit. Therefore, it is important to understand that the role of the citizen spouse often is limited to providing document support and proving the legitimacy of the relationship, and not necessarily to traveling together with the immigration benefit to the United States.

Generally, the American citizen who sponsors the foreign family member already lives in the U.S. territory and is not required to accompany them at all stages, such as the consular interview or entry with the immigrant visa. What matters is that all documentation and the process are carried out according to the current laws.

Thus, if the American spouse resides in the country, there is no legal requirement for them to travel together with the partner entering the United States with the IR1.

There are, however, situations where the spouse”s presence may facilitate the immigrant”s initial adjustment-for example, if the American citizen helps with accommodation and integration into their new routine. Even so, from the perspective of immigration regulations, the American spouse”s attendance is not imposed by the government during the visa issuance process.

Finally, I always recommend caution: follow U.S. immigration laws carefully, consult official sources, and seek guidance from specialized professionals-always taking care to avoid scams or miracle promises of quick results. Staying well informed and acting according to regulations is essential for a smooth and successful immigration process.
