The H-1B and the E-3 are work visas for specialty occupations, but they serve different audiences and have their own distinct dynamics when it comes to competition.

The H-1B is open to professionals of all nationalities and is highly sought after: when petitions exceed the annual cap, a cap selection (lottery) determines who moves forward. It also allows dual intent, meaning you can work temporarily while simultaneously pursuing permanent residence.

The E-3, in turn, is a category exclusively for Australian citizens. Like the H-1B, it requires employment in a specialty occupation, but the process tends to be less competitive and, in practice, does not go through a lottery.

  • Eligibility: the H-1B has no nationality restriction; the E-3 is only for Australians.
  • Competition: the H-1B may be subject to cap selection; the E-3 generally is not.
  • Duration: both are temporary and renewable as long as requirements continue to be met.
