The H-1B visa is intended for foreign workers who occupy positions in areas considered specialized, which generally means that the job requires at least a bachelor”s degree or its equivalent. This does not mean, however, that you need to prove you are a ”unique specialist” or possess skills that no one else has. The focus is on demonstrating that both the position and your qualifications fit the definition of a ”specialty occupation” according to the criteria of the U.S. Department of State.

In practice, the employer sponsoring your visa needs to show that the position indeed requires specific knowledge that is normally acquired through formal higher education. Thus, you must prove that you have the qualifications necessary to perform the job adequately, but it is not necessary to show that you are unique or exceptional in your field. It is worth noting that following U.S. immigration laws is essential, and it is always recommended to consult reliable sources or specialized firms to obtain proper guidance. Be cautious of unfounded promises or marketing campaigns that guarantee miraculous results, as each case is analyzed individually by U.S. immigration authorities.
