When we talk about Family Based visas, such as the F4 – intended for siblings of American citizens – it is important to understand that the sponsor (the one who provides the financial commitment) has a continuous and long-term responsibility. This commitment, formalized through the Affidavit of Support, is fundamental to ensure that the immigrant does not become dependent on public benefits.

In general, the sponsor”s obligation lasts until certain specific events occur, as provided by United States immigration law. As a rule, the sponsor must maintain financial support until the immigrant:
• Becomes a U.S. citizen;
• Accumulates 40 quarters (approximately 10 years of work) of employment credit, showing self-sufficiency;
• Permanently resides outside the United States; or
• In case of death.

It is important to emphasize that even if the immigrant obtains employment and reaches financial stability, the sponsor”s responsibility does not automatically end. This obligation continues in order to protect the State and prevent the new resident from becoming a burden on public funds.

If the immigrant receives public benefits that depend on means-testing, the sponsor may be called to reimburse the government for these amounts.

Given the complexity of the process and the rules involved, it is essential that the interested party carefully informs themselves and seeks reliable sources. Strictly following immigration laws, consulting specialized professionals, and avoiding offers that promise miraculous results are fundamental actions for a safe and successful journey.

Each case may have particularities, and staying well informed is always the best way to avoid unforeseen events and future complications.
