What is the difference between direct EB-5 and Regional Center EB-5?

The EB-5 program allows investors to obtain a permanent residence visa in the United States by making a significant investment that creates jobs in the country. Within this program, there are two main modalities: direct investment and investment through a Regional Center.

In the direct EB-5 model, the investor applies their capital directly to their own project or a specific enterprise, assuming an active role in managing and monitoring job creation, which demands greater control and commitment to the business.

On the other hand, the Regional Center alternative enables the investor to allocate funds in projects managed by approved centers, without direct involvement in management, since the center is responsible for operations and job creation, considering both direct and indirect jobs. Therefore, investing via a Regional Center may require less management effort.

Regardless of the choice, it is essential to comply with U.S. immigration laws, ensure compliance at all stages, and seek specialized guidance, avoiding promises of guaranteed results or misleading proposals. Both modalities present their own features and risks, requiring careful analysis to ensure fulfillment of legal requirements and to successfully obtain the EB-5 visa.
