In EB-5, the term ‘redeployment’ describes the reallocation of capital that has already been invested: instead of remaining in the original project, the funds are transferred to another eligible opportunity or venture when certain circumstances require that change.
This can occur, for example, when the initial project completes its phase and the capital still needs to remain deployed to meet the program’s objectives, particularly the maintenance of the investment and job creation. The reallocation must comply with the applicable program rules.
- Keeps the invested capital active and in compliance with EB-5.
- Must be carefully planned and documented.
- Cannot be done arbitrarily.
Because ‘redeployment’ has a direct impact on the integrity of the process, it is worth reviewing the current rules with USCIS and working with experienced professionals before any reallocation.
