Is there any priority review if I invest US$2 million?

Investing more in the EB-5, such as US$2 million, does not guarantee faster review or priority: USCIS evaluates each petition based on compliance with the requirements, not on the amount invested.

No. Investing a larger amount, such as US$2 million, does not create any preference or priority in the review of an EB-5 petition. The program has no mechanism that speeds up processing based on the amount invested.

Each petition is reviewed by USCIS (U.S. Citizenship and Immigration Services) based on compliance with the legal requirements, not on the size of the investment. Among the points evaluated are:

  • The lawful source of the invested funds.
  • The creation or preservation of the jobs required by the program.
  • Involvement in a qualifying enterprise.

Processing order follows the agency’s internal administrative criteria, and investing more than the minimum does not change that queue. For this reason, building a thorough and well-documented petition matters more than increasing the investment amount. Confirm the current rules at the official source (USCIS) and seek expert guidance.
