In general, the EB-5 process does not include a dedicated interview whose sole purpose is to validate the source of funds. Proof that the capital has a lawful origin is established primarily through documentation.

In practice, the investor must compile an extensive documentary record to submit alongside the investor petition for the program. Those documents typically include:

  • bank statements;
  • income tax returns;
  • sale-of-assets documents and other records that attest to the lawful origin of the funds.

USCIS officers review this material carefully. If questions arise about the source of funds, they may request additional evidence or, in some cases, an interview, but this is not a standard step dedicated solely to that purpose.

Because proving the source of funds is a sensitive stage in the process, keep your documentation organized and transparent. When in doubt, check the latest guidance from USCIS and work with a qualified specialist.
