There is no fixed limit or rule establishing an exclusive cap on equipment purchases within the amount invested in the EB-5. What truly matters is how that expenditure fits into the overall project.
All disbursements, including equipment acquisition, must be integrated into the business plan of the enterprise. That plan must clearly show how capital will be allocated and how each expense contributes to making the operation viable and to sustaining the job creation required by the program.
Coherence is the critical point. If the allocation toward equipment appears excessive or disproportionate relative to the rest of the investment, it may raise questions about the effective use of funds and affect the project’s review by the adjudicating authority. For that reason, financial planning should be supported by solid feasibility studies.
Since evaluation is conducted on a case-by-case basis, it is worth confirming updated guidelines with the USCIS and structuring the plan with specialized support, maintaining transparency in the allocation of resources.
