Job creation is the cornerstone of EB-5. To qualify, the investor must demonstrate that their capital contribution generated the required minimum number of full-time jobs for U.S. workers. That economic outcome is precisely what the program seeks in exchange for a path to permanent residence.
These jobs can arise in two ways, depending on how the investment is structured:
- Direct: created through the establishment or expansion of your own business.
- Indirect and induced: when the investment is made through an approved regional center, which can count jobs generated by the project’s broader economic impact.
The jobs must also be sustained throughout the period required by the program, and thorough documentation is a central part of the process. Because the exact number required may be revised over time, it is best to confirm the current requirement directly with USCIS and to structure the investment with the support of a qualified specialist.
