Having an EB-5 petition in progress does not automatically bar you from applying for a temporary visa, but the answer depends on the visa category and how each category treats the applicant’s intent. The EB-5 is an immigration pathway, meaning it is premised on permanent residence in the United States.

The sensitive point is what is known as intent. Many nonimmigrant temporary visas require applicants to demonstrate that they intend to stay for a limited period and then return to their home country. Having a permanent immigration process underway can make that demonstration more complex in certain categories.

On the other hand, some visas allow what is called dual intent: the applicant can meet the requirements for a temporary stay even while intending to immigrate in the future. Work visas such as the H-1B are examples where this policy is more openly recognized.
