Not automatically or unconditionally. The green card obtained through EB-5 grants permanent residence, but it starts as conditional residence: the investor receives the status for an initial period and must then go through the removal of conditions step to consolidate permanent residence without restrictions.
It is important not to confuse this with a simple renewal. The removal of conditions is not about renewing the card, but about demonstrating that the investment requirements were met. Once this step is completed, the holder has the same rights as any other permanent resident.
Even so, permanent does not mean irrevocable. The status can be lost in situations such as abandonment of residence, fraud or serious crimes, or failure to comply with the obligations set forth in immigration law.
- The EB-5 green card starts as conditional and then goes through the removal of conditions.
- Once consolidated, it is long-lasting, but requires maintaining the United States as a residence and complying with the law.
- Serious misconduct or abandonment of the status can lead to revocation.
Since the steps and requirements follow specific rules, confirm current requirements with USCIS and, if you have questions, evaluate your case with a specialist.
