The EB-5 program is an excellent alternative for investors seeking to immigrate to the United States. One of the main features of this program is that it allows the investor and their family to obtain a green card based on a qualified investment, provided the established requirements are met. However, it is important to understand how the conditional period works.

Initially, when the EB-5 visa petition is approved, the investor receives a conditional green card, valid for two years. This green card, although it is a permanent residence authorization, comes with a condition related to fulfilling the terms of the investment – such as maintaining the invested capital and creating at least 10 direct or indirect jobs for American citizens or residents.

Therefore, the EB-5 does not provide an unconditional green card immediately; what is granted is a conditional status. At the end of this two-year conditional period, the investor will need to apply for the removal of conditions (usually through Form I-829) to acquire permanent residence without conditions. This process requires proving that all program requirements have been duly met.

If there is any irregularity or lack of documentation, delays or even denial of the petition can occur, which is why strictly following immigration laws and keeping detailed records of the entire investment is crucial. It is worth emphasizing the importance of obtaining guidance from reliable and specialized sources, either through consultations with professionals working in the immigration field or companies recommended by official bodies.

In this way, it is possible to avoid falling victim to scams or marketing campaigns promising quick and guaranteed results, which can carry significant risks for the investor. In summary, the EB-5 offers a conditional green card right at the beginning of the process, but the removal of these conditions – and, consequently, obtaining the unconditional green card – only happens once the requirements are met and after the initial two years. Staying informed and following the rules established by immigration authorities is fundamental to succeeding in this journey.
