No. The EB-5 program does not include Health Department inspections as a program requirement. What EB-5 evaluates is the investment itself: the lawful source of funds, the deployment of capital, and the required job creation.

It helps to distinguish two things that are often confused:

  • Immigration medical examination: conducted by authorized physicians (civil surgeons), this exam is part of the process for anyone seeking permanent residence, not just EB-5 applicants. It concerns the applicant’s health, not an inspection of any business premises.
  • Business licenses and regulatory inspections: if the project operates in a sector that requires health permits, such as a restaurant or a laboratory, those requirements come from local or state rules that apply to the business itself, not from the EB-5 visa.

In other words, any health inspection applies to the business activity, not to the visa petition.
