Can the conditional green card be extended more than once?

The conditional green card granted through the EB-5 program is designed to be a temporary status, typically valid for two years. During this period, the investor must file the petition to remove conditions – by submitting Form I-829 – in order to convert the conditional status into full permanent residency.

In other words, the purpose of this period is to allow the immigration authority to verify whether the investments and job creation met the program’s requirements. Therefore, there is no possibility to extend the conditional green card beyond these two years. The process does not provide for multiple extensions of the conditional status.

If the petition to remove conditions is not filed within the deadline or is denied, the conditional status expires, and there is no new extension available to maintain this temporary status for a longer period. In exceptional cases where the removal petition is pending and the expiration date passes, there may be an automatic extension solely to allow the continuation of the review, but this does not constitute a new extension of the conditional period.

It is essential to strictly follow the rules established by the Department of Homeland Security and the United States Citizenship and Immigration Services, avoiding rash decisions based on doubtful information. It is recommended that any interested party seek specialized guidance from recognized and reliable sources, aiming to avoid scams, unfounded promises, or marketing campaigns that guarantee unrealistic results.
