The EB-5 visa was created to encourage investments that boost the United States economy, especially through the creation of jobs for American citizens. One of the program’s fundamental requirements is that the investment results in the generation of at least 10 full-time jobs-that is, positions characterized by a full work schedule.

Typically, for EB-5 purposes, a “full-time job” is defined as a role that involves, on average, 35 or more hours of work per week, adapting to the specific needs of the business. Thus, a job offered only on a part-time basis, by itself, would not meet the program’s required criterion. However, there is a possibility that multiple part-time jobs may be considered collectively equivalent to one full-time job-as long as it can be demonstrated that the combined hours meet or exceed the required number. This analysis usually depends on the company’s organizational structure and how the employment is distributed among workers.

It is important to emphasize that strict compliance with the requirements, especially regarding job creation, is fundamental for the success of the EB-5 process. Following United States immigration laws and maintaining detailed documentation are essential to avoid future problems. Therefore, seeking accurate information and relying on qualified specialists or consultants-avoiding scams or marketing campaigns that promise miracle solutions-is a prudent measure for those intending to invest under this program.

Keep in mind that regulatory details can be complex and their application may vary according to the specificities of the case. Staying updated and grounding everything on solid foundations is always the best strategy to navigate this process with safety and transparency.
