After obtaining the green card, does the investor need to provide annual reports to USCIS?

The EB-5 program allows foreign investors to legally reside in the United States through investment in projects that create jobs. Upon obtaining a green card – initially conditional for two years – the investor enters a phase in which they must demonstrate compliance with the program’s requirements to remove the conditions on their residency.

After the issuance of the conditional green card, the investor is not required to provide annual reports directly to USCIS regarding the progress of the investment. However, there are important obligations to be fulfilled during the two-year period.

At the end of this period, it is necessary to file a petition (Form I-829) to remove the conditions and prove that the investment indeed created the required jobs. This petition requires submission of documents detailing the evolution of the enterprise and how it generated the necessary jobs.

Even though there is no obligation for annual reporting, it is essential to maintain organized records and documentation throughout the entire process. Additionally, the investor must comply with all tax and regulatory obligations imposed by U.S. authorities.
