Why do some people prefer EB-2 PERM over NIW?

Both the EB-2 PERM and the EB-2 NIW (National Interest Waiver) lead to a green card through the second employment-based preference category, but by very different paths. The choice depends on the applicant’s profile, and there are real reasons why some prefer the PERM route.

The main one is predictability. The EB-2 PERM follows a structured, employer-driven process in which the sponsoring employer must recruit and demonstrate the unavailability of qualified U.S. workers for the position. Each step and requirement is clearly defined, which provides a sense of solid footing even though the process is bureaucratic.

The EB-2 NIW, on the other hand, waives the job offer requirement and allows self-petition, which is ideal for those with a strong independent track record. The trade-off is that it requires demonstrating the merit and national importance of the work, a more qualitative assessment. Applicants who have a willing employer sponsor and prefer more clearly defined criteria tend to feel more comfortable with the PERM route.
