The EB-2 NIW does not have a single deadline that applies to everything. The best strategy is to submit a complete and organized petition from the start, to reduce the chance of additional requests that delay the review.
Even so, some deadlines may appear along the way, and each has its own rule:
- If immigration requests additional evidence (Request for Evidence), the response deadline is stated in the notice itself that you receive.
- Later stages, such as a possible adjustment of status, have their own deadlines and requirements.
- Official USCIS communications may carry specific dates that must be met precisely.
Since these deadlines change and depend on each case, do not rely on numbers you hear secondhand. Always check what is written in your notice and in the current guidance from the official source (USCIS), and seek specialized support if in doubt.
