The EB-2 NIW (National Interest Waiver) visa is an option for professionals with advanced skills or advanced degrees who wish to make significant contributions to the interests of the United States. This process evaluates, among other criteria, the candidate’s potential positive impact in their field of expertise, regardless of their gender.

Regarding the Information Technology (IT) field, there is no formal policy or practice that establishes ‘affirmative action’ for women during the EB-2 NIW evaluation process. The central criterion of the NIW is based on the relevance and quality of the contributions the applicant can provide to the United States.

Thus, both women and men are evaluated impartially, based on professional achievements, publications, innovations, and potential to advance the sector of national interest. It is important to highlight that, although U.S. immigration law does not explicitly reward women in the NIW, the professional environment in the United States has independently sought to promote diversity and inclusion in sectors such as IT.

Such initiatives may create networking, mentoring, and support opportunities that can indirectly benefit talented female applicants, but these initiatives are separate and distinct from the rigor applied in the EB-2 NIW process.

Finally, I emphasize the importance of always following United States immigration laws and seeking updated information from reliable sources or specialized professionals. Avoid falling for promises of guaranteed results or marketing campaigns offering simplistic solutions to immigration issues. Each case is analyzed individually and requires a deep understanding of legal requirements and presented evidence.
