Is there a consular interview waiver if I am outside the U.S.?

In the EB-2 NIW, applicants who are already outside the United States typically complete the process through consular processing, and along that path a in-person interview is normally part of the immigrant visa procedure. Even so, the consulate itself may waive the interview in specific situations, evaluated on an individual basis.

The possibility of a waiver is neither automatic nor guaranteed: it depends on the applicant’s profile, the case history, and the current guidelines of the consular post and the Department of State. Renewals and certain profiles are often treated differently from a first-time application, but the final decision always rests with the consular officer.

Because waiver rules change frequently and vary from post to post, do not take an exemption for granted when planning your trip or relocation.
