How do you respond to an RFE that challenges the originality and impact of your publications?

An RFE (Request for Evidence) is a request from USCIS for additional information. In the EB-2 NIW, when it challenges the originality and impact of your publications, the goal of your response is to demonstrate, with objective evidence, why your work is relevant to the field and to the national interest.

Start with originality. Clearly explain what sets your research apart from prior studies:

• Compare your work with previously published studies and identify the knowledge gap you address.
• Highlight new methods, findings, or approaches you introduced.
• Reference peer review processes and comments that reinforce the novelty of your work.

Then address impact. Gather signals showing that other professionals use or recognize your work, such as citations, mentions at conferences, reviews, and independent analyses. Letters from experts who have no personal connection to you and hold recognized credentials are often a strong form of support.

Clarity and consistency matter: every document should reinforce the same argument. It is worth following updated USCIS guidance and reviewing your response with a specialist before filing.
