What is an RFE vs. NOID in EB-1?

In the EB-1 process, both the RFE and the NOID are communications from USCIS requesting more information before a final decision, but they indicate different stages and levels of risk.

The RFE (Request for Evidence) is issued when the adjudicator determines that the initial documentation is not sufficient to confirm eligibility. It is not a denial: it is an opportunity to supplement the petition with additional evidence that addresses the points raised. Responding fully and within the deadline stated in the notice itself is critical.

The NOID (Notice of Intent to Deny) is more serious. It indicates that USCIS is already inclined to deny the petition and gives the petitioner a final chance to present compelling evidence that reverses that determination. It typically arises when the concerns are substantive, not merely a documentation gap.

• RFE: evidence is lacking; no adverse position on the merits has been formed yet.
• NOID: there is already an inclination to deny, and the burden of persuasion is higher.
