In the EB-1B, my institution has only two researchers. Does that make the petition unviable?

The EB-1B is the employment-based immigration category for outstanding researchers and professors who demonstrate international recognition in their field. Part of the analysis looks at the employer or institution offering the position, which must show an active and consistent research environment.

Having a small research team does not automatically make the petition unviable. The size of the research staff is only one of several factors, and there is no magic number that guarantees or prevents approval. What truly carries weight is the quality and continuity of research activity, along with the candidate’s own track record and accomplishments.

When the institution’s structure is lean, it is possible to strengthen the petition with additional evidence, such as:

• Ongoing research projects and their relevance in the field.
• Publications, patents, and concrete results from the work conducted.
• The candidate’s central role within that research environment.

Since each case is evaluated individually, it is worth reviewing the updated requirements with USCIS and assessing your profile with a specialist before filing.
