Even so, approval never rests on the title alone. Authorities examine the actual nature of the responsibilities in each position, the company structure, the connection between the foreign unit and the US headquarters, and the evidence that you fulfilled the qualifying period in an executive capacity before the transfer. Meeting the required period is one of the requirements, but it does not guarantee the outcome on its own.

- Establish the connection between the foreign entity and the US company.
- Gather records that demonstrate continuity of managerial functions.
