When a United States citizen sponsors a foreign spouse through the CR1 visa, they assume a significant financial responsibility. This commitment involves signing Form I-864 (Affidavit of Support), which is an integral part of the immigration process to ensure that the beneficiary does not become dependent on public assistance. In practice, the sponsor remains financially responsible for the immigrant as long as the immigrant has not qualified for U.S. citizenship. This means that even after the spouse becomes a conditional resident and later removes the conditions on the residence, the obligation persists.

The obligation can be extended until the immigrant obtains citizenship, or, in some cases, until they accumulate 40 quarters of work in the United States (approximately 10 years) under Social Security coverage. Until one of these milestones is reached, the sponsor is legally required to support the immigrant, if necessary, to prevent them from becoming a public charge.

It is important to remember that this obligation is strictly enforced by immigration authorities and, therefore, it is essential that the sponsor is aware of all their duties. Changes in the immigrant’s status, such as divorce or other family changes, do not necessarily relieve this responsibility unless there is an official change in immigration status – such as the beneficiary acquiring citizenship.
