Most EB-2 NIW cases for engineers that get denied make the same mistake: they focus too much on the professional’s technical qualifications and not enough on the argument for value to the United States. Being a competent engineer is not enough. The case needs to demonstrate that this professional’s specific work has an impact beyond the company where they work, one that benefits an industry, a region, or American society more broadly.

Recommendation Letters

Recommendation letters are the most critical element. They need to be written by engineers or specialists with recognized authority in the field, clearly explain the impact of the applicant’s work, and demonstrate genuine knowledge of the contributions presented. Generic letters that praise the professional without detailing the specific impact of their work are among the leading causes of denial or requests for additional evidence (RFE) in these cases. Mistakes That Weaken the Petition

The second is confusing the importance of the field with the importance of the professional: the sector may have evident national importance, but the case still needs to connect that individual to the field’s concrete advancement. The third is treating the third Dhanasar criterion as filler text, without explaining why requiring a job offer and labor certification, in that specific case, would harm U.S. interests. Each of these flaws tends to result in an RFE, or an outright denial.

Costs and Timelines in 2026

It is worth separating the immigrant petition (Form I-140) from the rest of the process. The base USCIS filing fee for the I-140 is $715. EB-2 NIW allows for premium processing: with Form I-907, USCIS commits to acting within 45 calendar days, approving, denying, issuing an RFE, or notifying intent to deny. The premium processing fee for the I-140 rose to $2,965, in effect since March 1, 2026 (previously $2,805). Without premium processing, standard I-140 processing in 2026 typically ranges from 8 to 14 months, depending on the service center.

Approving the I-140, however, is not the end of the road: obtaining the green card depends on the Visa Bulletin being current for the EB-2 category and the applicant’s country of chargeability, since global demand creates backlogs of varying degrees. This is why planning an EB-2 NIW case means planning two timelines: the petition itself and the availability of an immigrant visa number.

Before starting any petition, the engineer needs to take an honest inventory of their own track record. Which projects have documented, measurable impact? Which recognized specialists can write letters with real substance? Which elements of the resume demonstrate contribution beyond routine work? The practical conclusion is straightforward: EB-2 NIW is not a club closed to academics.
