The O-1 visa is reserved for individuals with extraordinary ability in fields such as arts, sciences, education, business, or athletics. Unlike categories with a restricted annual number of slots, such as the H-1B, the O-1 is not subject to an annual cap or specific quota.

In practice, this means a petition can be filed at any time of year, without depending on a lottery or a registration window. There is no numerical ceiling that, by itself, would prevent a visa from being granted to someone who genuinely meets the requirements.

The absence of a quantitative cap, however, does not make the process straightforward. The O-1 is a demanding category: the applicant must demonstrate outstanding recognition and extraordinary ability in their field, backed by robust documentation evaluated on a case-by-case basis by the USCIS.
