It is important to understand the different paths and procedures for each family member when it comes to immigrant visas. In the case of the K-3 visa, which was created to reduce the wait time for the family of a U.S. citizen spouse, the rule is somewhat different when it comes to dependents. For children under 21 years old and unmarried of the K-3 beneficiary, they can normally be included as dependents through the K-4 visa. This means that when applying for the visa, each child must have their own application form (such as the DS-160, for example) and provide documentation proving the family relationship, but it is not necessary to start a completely separate petition, such as the I-129F, specifically for each child.

In other words, the process starts with the petition for the spouse (the K-3 visa applicant) and, subsequently, eligible children are listed so that they can accompany with the K-4 visa. However, it is worth noting that, although an independent petition is not required from the start, each child will have to comply with individual application procedures at the U.S. consulate or embassy, such as completing forms, undergoing medical exams, and scheduling interviews when necessary.

Attention: it is essential to strictly follow U.S. immigration laws. Always seek information from official sources and, if applicable, consult specialized professionals who can provide detailed guidance for your case to avoid scams or promises of miraculous results. This way, you ensure that the entire process is carried out correctly and safely.

Always remember: each situation may have its particularities, so it is essential to be well informed and proceed with caution at every step of the process.
