How does the H-1B cap petition selection process work?

The H-1B operates under an annual limit on petitions, known as the cap, established by U.S. legislation. There is also an additional portion reserved for candidates who completed a graduate degree at a U.S. institution of higher education.

When the number of registrations exceeds the available slots for the year, a lottery comes into play: a random drawing determines which petitions move forward for review. In other words, meeting the requirements does not guarantee selection, because the cap stage also depends on that drawing when demand is high.

This is why many qualified professionals may not be selected in a given cycle, even if they meet all the criteria. Cap selection is a separate step from the merit review of the petition itself.
